
When you take custody of an offender you are also assuming responsibility for his/her healthcare. You rely on the offender to keep you aware of medical problems, and you rely as well on the ability of your staff to identify health concerns and respond effectively to them.
Despite your best efforts and intentions, however, your operation will still draw healthcare-related complaints and legal claims. Mounting a successful response to such challenges involves identifying the underlying motives of the claimant, which leads to an understanding of how the offender will structure his/her case. Sound medical documentation is another key.
Since 1986 I have investigated a comprehensive array of offender legal claims (tort claims, civil actions and civil rights cases), developing the information that forms the basis for interrogatories, admissions, declarations and motions. My work in this arena has been well-regarded by attorneys and investigators with the Indiana Department of Correction and Attorney General’s Office.
